NEW PUBLICATION FROM IKV, THE RELATIONSHIP BETWEEN INDUSTRY AND ENVIRONMENT: THE EUROPEAN AND TURKISH LEGISLATIONS ON THE PREVENTION OF MAJOR INDUSTRIAL ACCIDENTS

The publication prepared by Melis Bostanoğlu aims at assessing the European and Turkish legislations on the prevention of major industrial accidents.

As a result of the catastrophic accident that took place in Seveso, Italy in 1976, the existing measures against industrial accidents were deemed to be insufficient by the European Economic Community. The Seveso Directive (Directive 82/501/EEC) was adopted in 1982 in order to take necessary measures and prevent industrial accidents which might take place in the future. This legislation was amended and upgraded several times. Finally, Seveso-III (Directive 2012/18/EU) was adopted in 2012 taking into account the changes in the Union legislation on the classification of chemicals and enhanced rights for citizens to access information and justice.

On the other hand, Turkey prepared a similar legislation entitled “Reducing Major Industrial Accident Risks” (BEKRA legislation) within the scope of its EU harmonisation process, and adopted the “Regulation on Control of Major Industrial Accidents” on 18 August 2010. This legislation was harmonised with the Seveso III Directive and adopted with the title of “Regulation on Prevention of Major Industrial Accidents and Reducing their Effects” on 2 March 2019.

This publication aims at assessing the European and Turkish legislations on the prevention of major industrial accidents, and revealing similar and different aspects of these legislations.
