The panel entitled “Problems and Solutions Related to the Law on the Collection Procedure of Public Receivables” was held in TOBB Plaza, Istanbul by IKV in collaboration with Istanbul Tax Center (IVM) on 1 February 2018.

On behalf of IVM, Chairman Prof. Hakan Üzeltürk made a informational opening speech regarding the works of the Center. Following Üzeltürk’s higlights regarding the importance of the panel’s subject, IKV Legal Advisor Abdulkadir Güzeloğlu delivered a speech. After having given information regarding IKV, Güzeloğlu underlined the significance of solving law related problems.

The first session’s moderator was IVM Executive Board Member Mustafa Koç and the panelists were Prof. Dr. Binnur Çelik, Assoc. Prof. İrfan Barlas and Assoc. Prof. Barış Bahçeci. IVM Executive Board Member Koç highlighted the on-going legislative works related to other streams of Turkish law yet he expressed that work on the Law on the Collection Procedure of Public Receivables done is not adequate enough. Afterwards, within the framework of the current tax legislations, Prof. Dr. Çelik addressed the issues of guarantees, liens and the Law on the Collection Procedure of Public Receivables related problems in this regard.

Assoc. Prof. İrfan Barlas, who stated that the weakness of some provisions of this law also have weakened the entire legislative structure mentioned the insufficiencies causing legal holes in the law. Finally, Assoc. Prof. Barış Bahçeci, during his presentation entitled “Use of Distraint Authority in the Framework of the ECHR Case Laws” gave information regarding the supervisions and prejudications of the ECHR. First session came to an end after a short Q&A.

The moderator of the second session was Dr. Veysi Seviğ and the panelists were Rıza Bilgiç, Dr. Bumin Doğrusöz and Mustafa Tan. Dr. Seviğ touched upon the necessity of some alterations solving the injustices in taxation. Afterwards, Rıza Bilgiç, who made a presentation entitled “Special Issues in Law No. 6183”, gave information regarding electronic distrait execution and cases on savings. The session proceeded with the Dr. Bumin Doğrusöz’s remark on the problems concerning payment order and declaration of property related provisions. Lastly, Mustafa Tan, who made a presentation entitled “Liabilities of the Shareholders and Legal Representatives”, explained the legal and criminal liabilities of shareholders and legal representatives of businesses in which the capital is divided or undivided into shares. Following the Q&A session and the plaques presentation ceremony, the event came to the conclusion.
